Waarom is de wet DBA ingevoerd?
De wet DBA (Deregulering Beoordeling Arbeidsrelaties) is sinds 2016 de vervanger van de Verklaring Arbeidsrelatie, de VAR. Het doel van de wet DBA is om zzp’ers en hun opdrachtgever duidelijkheid te geven over de arbeidsrelatie die ze met elkaar aangaan.
Wat doe je als opdrachtgever?
Daarbij geven we ze de volgende adviezen mee.
- Zorg dat je de regie houdt in het gesprek.
- Zorg ervoor dat je achterhaalt waarom er niet wordt betaald.
- Maak duidelijke afspraken en leg deze schriftelijk of per e-mail vast.
- Je opdrachtgever is het er niet mee eens.
- Wat je vooral niet moet doen.
Waarom een modelovereenkomst?
Een modelovereenkomst is een soort contract voor ZZP’ers dat bewijst dat zij daadwerkelijk zelfstandig werken. Hier kunnen opdrachtgevers namelijk om vragen als zij over jouw zelfstandigheid twijfelen.
